BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:
Description:
A 3.83 ± acre tract of land approximately ½ ± of a mile west of Alley Jackson Road on the north side of Easley Road and specifically described as: A part of the Northwest Quarter of Section 9, Township 47, Range 30, Jackson County, Missouri described as follows: Commencing at the Southwest corner of the Northwest Quarter of said Section 9; thence North 89 degrees 32 minutes 38 seconds East along the South line of the Northwest Quarter, 695.95 feet to a point of curvature and being the Point of Beginning; thence along said curve to the left having a Radius of 284.54 feet and a distance of 36.15 feet; thence North 02 degrees 08 minutes 14 seconds West, 615.13 feet; thence South 89 degrees 47 minutes 46 seconds East, 354.55 feet; thence South 00 degrees 12 minutes 14 seconds West, 358.90 feet to a point on the Northerly Right of Way line and being a point on a curve; thence along said Northerly Right of Way line and a curve to the left with an Initial Tangent Bearing of South 80 degrees 38 minutes 19 seconds West, a Radius of 185.00 feet and a distance of 117.83 feet; thence continue along said Northerly Right of Way line, South 44 degrees 19 minutes 35 seconds West, 288.78 feet; thence continue along said Northerly Right of Way line, South 80 degrees 56 minutes 06 seconds West, 59.46 feet to the Point of Beginning. Containing 3.83 acres, more or less.
Section 2. The Legislature, pursuant to the application of Sbisa Homes, Inc., (RZ-2005-384), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application in a public hearing on November 17, 2005, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
