Body

WHEREAS, by Ordinance 3657, dated August 8, 2005, the Legislature did appropriate proceeds of the Series 2005 Public Building Corporation Leasehold Revenue Bonds for various capital improvement projects throughout the County; and,

WHEREAS, by Resolution 15892, dated May 15, 2006, the Legislature did authorize the County Executive to execute a Cooperative Agreement and Addendum with the City of Independence, MO, in connection with the 39^th Street (Noland to Lee's Summit), 39^th Street (Noland to Crysler), 35^th & Noland Road, Truman Road (M-291 to Swope), and R.D. Mize (Little Blue Parkway to Eureka) public improvement projects, at a total cost to the County not to exceed $4,000,000.00; and,

WHEREAS, the City has requested and the Director of Public Works now recommends that the funds for the implementation of these projects, be reallocated within the projects as set forth below:

WHEREAS, such reallocation of funds is in the best interests of the health welfare, and safety of the citizens of the County; and,

WHEREAS, the attached Second Addendum to the Cooperative Agreement provides a suitable mechanism by which to accomplish the recommended reallocation of funds; now therefore,

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the Second Addendum to Cooperative Agreement with the City of Independence, in a form to be approved by the County Counselor; and,

BE IT FURTHER RESOLVED that the Director of the Department of Finance and Purchasing be and hereby is authorized to make all payments except final payment on the Second Addendum.

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
