AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RE (Residential Estates), a certain 11 ± acre tract.

ORDINANCE 3164, August 6, 2001

 

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description:  A 11± acre tract of land generally located 1/4 of a mile west of Rust Road on the south side of Duncan Road  and more specifically described:

 

Part of the NE 1/4, NE 1/4, Section 27, Township 49, Range 30, Jackson County, Missouri described as follows:  Beginning at the NE corner of said NE 1/4; Thence N89°33'49"W along the North Line of said NE 1/4, 934.95 feet to a point that is S89°33'49"E, 375.78 feet from the NW corner of said NE 1/4, NE1/4; Thence S00°97'46"W, parallel with the East line of said NE 1/4, 40.00 feet to a point on the South Right-of-Way of Duncan Road as established by Document No. 760207, said point being the TRUE POINT OF BEGINNING, of the tract to be decided herein; thence S00°07'40"W, parallel with the East line of said NE 1/4, 1284.21 feet to a point on the South line of said NE 1/4, NE 1/4, said point being N89°33'45"W, 934.95 feet from the SE corner of said NE 1/4, NE 1/4; thence N89°33'45"W along said South Line, 377.37 feet to the SW corner of said NE 1/4, NE 1/4; thence N00°11'53"E along the West Line of said NE 1/4, NE 1/4, 1284.20 feet to a point on said South Right of Way, said point being S00°11'53"W, 40.00 feet from the NW corner of said NE 1/4, NE 1/4; thence S89°33'49"E along said South right-of-way and parallel with and 40.00 feet South of the North Line of Said NE 1/4, 375.83 feet to the True point of Beginning.

 

 

Section 2.  The Legislature, pursuant to the application of Michael and Carol McKenzie (RZ-2001-240), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing  on July 19, 2001, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
