Body
WHEREAS, the Road and Bridge Division of the Public Works Department is in need of a John Deere 524K loader; and,
 
WHEREAS, the Director of Finance and Purchasing recommends the award of a contract for the purchase of this equipment to Murphy Tractor & Equipment of Kansas City (Clay County), MO, under the terms and conditions set forth in Missouri Department of Transportation Contract No. 03-120320RJ, an existing government contract, at an actual cost to the County of $113,100.00; and,
 
WHEREAS, the Public Works Department desires to trade-in on this purchase a 2009 John Deere 710J Backhoe, with a trade-in value of $110,000.00, bringing the cost of the new loader to $3,100.00; and,
 
WHEREAS, the Director of Finance and Purchasing recommends the award to Murphy Tractor & Equipment under the existing government contract due to the higher volume discounts offered to larger entities; and,
 
WHEREAS, pursuant to section 1030.4, Jackson County Code, 1984, the Director of Finance and Purchasing is required to submit any purchase under an existing government contract which exceeds $25,000.00 to the Legislature for approval; and,
 
WHEREAS, the Director of Finance and Purchasing recommends that the John Deere 710J Backhoe be declared surplus property to be used as a trade-in for this purchase; and,
 
WHEREAS, a transfer is necessary to fund this purchase; and,
 
WHEREAS, the County Executive recommends the transfer; now therefore,
 
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the following transfer be made within the 2012 Road and Bridge Fund:

BE IT FURTHER RESOLVED by that award be made as recommended by the Director of Finance and Purchasing, and that the Director be and hereby is authorized to execute for the County any documents necessary to the accomplishment of the award; and,
 
BE IT FURTHER RESOLVED that the surplus property indicated within the Public Works Department be and hereby is declared surplus, and that the Director of Finance and Purchasing be and hereby is authorized to dispose of it by way of trade-in pursuant to chapter 11 of the Jackson County Code; and,
 
BE IT FURTHER RESOLVED that the Director of Finance and Purchasing is authorized to make all payments, including final payment on the contract.
 
Enacted and Approved
Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
