BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:
Description: A 5.7 ± acre tract of land approximately 1/10 of a mile south of Pink Hill Road on the west side of Dillingham Road and generally described as:
All that part of the Northwest quarter of Section 22, Township 49, Range 30 in Jackson County, Missouri more particularly described as follows: Beginning at the Northeast corner of the Northwest quarter of the Northwest quarter of said Section 22, thence South 01 degrees 01 minutes 05 seconds West along the East line of the Northwest quarter of the Northwest quarter of said Section 22 a distance of 426.24 (Plat = South 0 degrees 44 minutes 21 seconds East, 426.14 feet) to the Point of Beginning thence continuing South 01 degrees 01 minutes 05 seconds West along the East line of the Northwest quarter of the Northwest quarter of said Section 22 a distance of 545.90 feet; thence North 88 degrees 15 minutes 43 seconds West a distance of 545.79 feet; thence North 01 degrees 44 minutes 17 seconds East a distance of 429.57 feet to a point on the South line of SUNRISE ACRES, a subdivision in Jackson County, Missouri; thence South 87 degrees 20 minutes 43 seconds East (Plat = South 89 degrees 05 minutes East) along said South line a distance of 35.54 feet; thence North 78 degrees 44 minutes 17 seconds East (Plat = North 77 degrees East) along said South line a distance of 136.00 feet; thence South 81 degrees 20 minutes 43 seconds East (Plat = South 83 degrees 05 minutes East) along said South line a distance of 52.00 feet; thence South 69 degrees 02 minutes 43 seconds East (Plat = South 70 degrees 47 minutes East) along said South line a distance of 83.00 feet; thence South 85 degrees 42 minutes 43 seconds East (Plat = South 87 degrees 27 minutes East) along said South line a distance of 41.00 feet; thence North 54 degrees 35 minutes 38 seconds East (Plat = North 52 degrees 51 minutes 21 seconds East) along said South line a distance of 200.63 feet (Plat = 200.81 feet); thence South 89 degrees 00 minutes 04 seconds East (Plat = North 89 degrees 15 minutes 39 seconds East) along said South line a distance of 40.00 feet to the Point of Beginning. Containing 5.757 acres. Except that part in Road.
Section 2. The Legislature, pursuant to the application of Paul Morgenroth (RZ-2002-262), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on April 18, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
