BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District, so that there will be transferred from District A to District RR, a tract of land described as follows:
Description:
The 19.5 ± acres are approximately 1/4 of a mile north of Truman Road (Mo. Route FF) on the west side of Outer Belt Road (Mo. Hwy. H) and specifically described as:
Part of the East 60 acres of the North half of the Southwest quarter, and also that part of the Northwest quarter of the Southeast quarter lying West of Missouri State Route "H", all in Section 8, Township 49, Range 29, in Jackson County, Missouri, more particularly described as follows:
Commencing at the Southeast corner of the Southwest quarter of Section 8, Township 49, Range 29; thence North 01 degrees 21 minutes 41 seconds East (Deed=North 01 degrees 21 minutes 31 seconds East) along the East line of the Southwest quarter of said Section 8 a distance of 1332.12 feet (Deed= 1331.62 feet) to the Southeast corner of the Northeast quarter of the Southwest quarter of said Section 8, said point being the Point of Beginning; thence North 86 degrees 02 minutes 29 seconds West (Deed= North 85 degrees 41 minutes 31 seconds West) along the South line of the Northeast quarter of the Southwest quarter of said Section 8 a distance of 560.72 feet; thence North 04 degrees 29 minutes 12 seconds East a distance of 1328.21 feet to a point on the North line of the Southwest quarter of said Section 8; thence South 86 degrees 20 minutes 47 seconds East (Deed=South 86 degrees 24 minutes 36 seconds East) along the North line of the Southwest quarter of said Section 8 a distance of 488.12 feet to the Northwest corner of the Southeast quarter of said Section 8; thence continuing South 86 degrees 20 minutes 47 seconds East (Deed=South 86 degrees 24 minutes 36 seconds East) along the North line of the Southwest quarter of said Section 8 a distance of 375.08 feet to a point on the Westerly (Deed=Easterly) right-of-way of Missouri State "H" as presently established; thence in a Southwesterly direction along the Westerly right-of-way of Missouri State Route "H" and along a curve to the right, having an initial tangent bearing of South 09 degrees 17 minutes 43 seconds West and a radius of 4871.07 an arc distance of 997.61 feet; thence South 21 degrees 01 minutes 47 seconds West along the Westerly right-of-way of Missouri State Route "H" a distance of 253.94 feet to a point of curve; thence in a Southwesterly direction along the Westerly right-of-way of Missouri State Route "H" and along a curve to the left, being tangent to last described course and having a radius of 1472.39 feet and arc distance of 117.01 feet to a point on the South line of the Northwest quarter of the Southeast quarter of said Section 8; thence North 86 degrees 02 minutes 29 seconds West (Deed=North 85 degrees 41 minutes 31 seconds West) along the South line of the Northwest quarter of the Southeast quarter of said Section 8 a distance of 16.79 feet to the Point of Beginning. Except a tract of land conveyed by warrant deed Document Number 200310078572 as recorded at Jackson County on July 2, 2003 and more particularly described as follows: All that part of the Northeast quarter of the Southwest quarter and the Northwest quarter of the Southeast quarter of Section 8, Township 49, Range 29 and described as beginning at a point 784.07 feet (Deed-786.60 feet) North of the Southeast corner of the Northeast quarter of the Southwest quarter of said Section 8; thence South 89 degrees 12 minutes 29 seconds West (Deed=South 86 degrees 58 minutes 30 seconds West) a distance of 520.15 feet (Deed=546.60) feet to a point; thence North 04 degrees 29 minutes 12 seconds East (Deed-North 2 degrees 15 minutes 30 seconds East) a distance of 175 feet to a point; thence North 89 degrees 12 minutes 29 seconds East (Deed=North 86 degrees 58 minutes 30 seconds East) a distance of 824.41 feet) to the Westerly right-of-way of Missouri State Highway Route "H"; thence in a Southwesterly direction along the Westerly line of said right-of-way and along a curve to the right, having an initial tangent bearing of South 13 degrees 26 minutes 21 seconds West and a radius of 4871.07 feet an arc distance of 180.67 feet (Deed=175 feet more or less) to a point; thence South 89 degrees 12 minutes 29 seconds West (Deed=South 86 degrees 58 minutes 30 seconds West) a distance of 272.70 feet (Deed=245.97 feet) to the Point of Beginning, all in Jackson County, Missouri except any part in roads. Total area less exception is 19.51 acres.
Section 2. The Legislature, pursuant to the application of Donald Schmidt (RZ-2004-338), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on May 20, 2004, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
