Body
WHEREAS, the Burlington Northern and Santa Fe Railway Company ("BNSF") has recommended to the Missouri Highway and Transportation Commission ("MHTC") the installation of new flashing light signals and gates with redundant constant warning time circuitry and sidelights at an existing grade crossing within Jackson County, Missouri identified as DOT # 005 372J; and,
WHEREAS, the identified grade crossing is located at the point where Mable Street intersects the Burlington Northern and Santa Fe Railway Company railroad tracks in Atherton, Missouri and along a route presently maintained by the County; and,
WHEREAS, the MHTC has requested the execution of a three-party Agreement ("Agreement") with by BNSF and the County wherein MHTC will utilize federal funds to pay for 80% of the installation cost and that the BNSF will pay 20% of the cost of the installation; and,
WHEREAS, under the Agreement, Jackson County will be responsible for cooperation in handling of traffic during construction, and will install and maintain advance warning signs and pavement markings as required by law and regulation within the budgeted funds of the Jackson County Department of Public Works; and,
WHEREAS, the improvements made to this railroad crossing will increase safety for the benefit of increasing number of the citizens of Jackson County operating vehicles in this area; and,
WHEREAS, the attached Agreement will secure the funding for improvements and confirm the understanding of the parties; now therefore,
BE IT RESOLVED, by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached Agreement with the Missouri Highway and Transportation Commission and The Burlington Northern and Santa Fe Railway Company for the installation of flashing light signals and gates in Atherton, Missouri.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
