IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title A RESOLUTION authorizing the County Executive to execute an Indemnification Agreement with the City of Kansas City, Missouri, as to a certain sewer line in connection with the additions and alterations to the Jackson County Detention Center. Intro RESOLUTION # 11650, March 10, 1997 Body INTRODUCED BY Dixie M. Flynn, County Legislator WHEREAS, in connection with the construction of the Jackson County Detention Center alterations/addition, a corridor will be built connecting the existing jail to the new annex; and, WHEREAS, the corridor will be constructed over an existing sanitary sewer lying in an easement held by the City of Kansas City; and, WHEREAS, the City of Kansas City has requested assurances that any sewer within such easement will be fully protected during the construction of the corridor and thereafter; and, WHEREAS, the Director of Public Works has negotiated and recommends the terms of the attached Indemnification Agreement to provide the City these assurances; and, WHEREAS, the under the proposed Agreement the County will indemnify the City of Kansas City against increased liability and expenses arising out of the construction of the corridor, and will pay any increased costs of repairs for reconstruction of the sewer occasioned due to the corridor being located in the easement for the sewer; now therefore, BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the attached agreement is hereby approved, and that the County Executive be and hereby is authorized to execute the attached Agreement on behalf of the County. Attorney Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
