AN ORDINANCE appropriating $159,095.00 from the fund balance of the 2010 Health Fund, authorizing the County Executive to execute an addendum to the Professional Architectural Design Services Agreement with Patterson Latimer Jones Brannon Denham, Inc., for design architectural services in connection with the construction of a shared animal shelter facility, at a cost to the County not to exceed $134,095.00, and authorizing the County Executive to execute a Professional Services Agreement with Courtney Thomas, of Raymore, MO, for design and construction oversight of the project, at a cost to the County not to exceed $25,000.00.

Body
WHEREAS, by Resolution 16964, dated July 13, 2009, the legislature did authorize the County Executive to execute an Agreement for Professional Architectural Design Services with Patterson Latimer Jones Brannon Denham, Inc., for design architectural services in connection with the construction of a shared animal shelter facility; and,
WHEREAS, additional time is necessary to complete a redesign based on a revised conceptual plan to ensure that the animal shelter project can be constructed within budget; and,
WHEREAS, the Director of Public Works recommends amending the existing design agreement with Patterson Latimer Jones Brannon Denham, Inc., to allow additional time for said redesign, at an additional cost to the County not to exceed $134,095.00; and,
WHEREAS, a technical expert to consult in the design of the shelter would ensure the County will have a quality facility, while meeting budgetary limitations; and,
WHEREAS, the Director of Public Works recommends the execution of a professional services agreement with Courtney Thomas of Raymore, Missouri because of her specific experience and knowledge on the operation of an animal shelter, at a cost to the County not to exceed $25,000.00; and,
WHEREAS, an appropriation is necessary to cover these costs; and,
WHEREAS, the County Executive recommends this appropriation; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the undesignated fund balance of the 2010 Health Fund be and hereby is made:

BE IT FURTHER ORDAINED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute an addendum to the Professional Architectural Design Services Agreement with Patterson Latimer Jones Brannon Denham, Inc., increasing the scope of that firm's services at a cost to the County not to exceed $134,095.00, in a form to be approved by the County Counselor; and,
BE IT FURTHER ORDAINED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute a professional services agreement with Courtney Thomas, at a cost to the County not to exceed $25,000.00, in a form to be approved by the County Counselor; and,
BE IT FURTHER ORDAINED that the Director of Finance and Purchasing is authorized to make all payments, including final payment on the agreements and addenda thereto.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
