Title

AN ORDINANCE appropriating $4,587,703.00, from the unappropriated surplus of the 2001 Criminal Justice Improvement Fund and awarding a contract for the furnishing of energy performance contracting services to Johnson Controls, Inc., of Lenexa, KS, at an initial cost of $3,833,115.00, and a five-year cost of $4,590,333.00.

Body

WHEREAS, the County and the City of Kansas City, Missouri, jointly requested proposals for the furnishing of energy performance contracting services for use by both entities at their buildings in the downtown Kansas City government complex; and,

 

WHEREAS, proposals were received from the following:

                                                                                                           Miami, FL

 

                                                                                                         Unicom Energy Services, Inc.

                                                                                                            Merriam, KS

 

                                                                                                         Johnson Controls, Inc.

                                                                                                            Lenexa, KS

 

and,

WHEREAS, a joint evaluation team, consisting of city and county officers and employees, as well as private consultants, recommend that contracts be awarded to Johnson Controls, Inc., of Lenexa, KS, for the reason that its proposal best met the primary objectives of the project, which include the implementation of energy conservation measures, with guaranteed energy, water, operations, and maintenance savings; and,

 

WHEREAS, under the team's recommendation, the County would execute the following contracts with the vendor:

and,

 

WHEREAS, for as long as the service agreements are in effect, up to fifteen years, Johnson Controls will guarantee, on an annual basis, that the County will recoup the amortized costs of the improvements and services out of savings in energy and other operational costs; and,

 

WHEREAS, the service agreements are subject to annual renewal by the county; and,

 

WHEREAS, in order to fund this expenditure, an appropriation is necessary; and,

 

WHEREAS, the county executive recommends said appropriation as an amendment to her proposed 2001 County budget; now therefore,

BE IT ORDAINED by the County Legislature of Jackson County, Missouri that the following appropriation and transfer be made:

BE IT FURTHER RESOLVED that the Purchasing Director be and hereby is authorized to execute a Master Agreement Performance Contract, Planned Service Agreement, and Results-Oriented Service Agreement, with Johnson Controls, Inc., in a form to be approved by the County Counselor; and,

 

BE IT FURTHER RESOLVED that the Manager of the Division of Finance be and hereby is authorized to make all payments including final payments on the contracts to the extent that sufficient appropriations are contained in the then current county budget.

 

Enacted and Approved

Effective Date:  This ordinance shall be effective immediately upon its signature by the County Executive.
