AN ORDINANCE appropriating $6,076.00 from the fund balance of the 2011 General Fund in acceptance of a reimbursement from the federal judiciary for monetary sanctions paid related to inmate population control issues.

Body
WHEREAS, the County has received the reimbursement of excess monetary sanctions paid by the County in the 1990s, in the amount of $6,076.00, in the case styled Rahn Hall, et al. v. Jackson County Department of Corrections, et al., when the inmate population of the Jackson County Detention Center exceeding the court-ordered population capacity on two instances during that period of time; and,
                                    
WHEREAS, the ongoing monitoring of population control issues by the court in this case was terminated in 2007, and the court has determined that these funds should be reimbursed to the County, to be used to directly benefit the inmate population; and,
 
WHEREAS, the Department of Corrections recommends that the funds be used to purchase new computers, a new printer, and classroom supplies for the GED program and the law library; and,
 
WHEREAS, an appropriation is necessary to place the funds in the proper spending accounts; now therefore,
 
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation be and hereby is made:
