BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:
Description: A 42.5 ± acre tract of land is approximately ½ mile east of Gammon Road on the north side of Stringtown Road and specifically described:
All that part of the East ½ of the SE 1/4 of Section 28, Township 47 North, Range 30 West of the Fifth Principal Meridian, now in Jackson County, Missouri, more particularly described as follows: Beginning at the Southeast corner of the SE 1/4 of said Section 28; thence S 89°54'40"W, along he South line of the SE 1/4 of said Section 28, a distance of 1328.39 feet, to the Southwest corner of the E ½ of the SE 1/4 of said Section 28; thence N 2°21'28"E, along the West line of the E ½ of the SE 1/4 of said Section 28, a distance of 1355.54 feet; thence N 89°54'40"E, along a line parallel with the South line of the SE 1/4 of said Section 28, a distance of 553.69 feet; thence N 13°54'10"W, a distance of 55.10 feet, to a point of curvature; thence Northwesterly, along a curve to the right, having a radius of 1525 feet and a central angle of 0°11'20", a distance of 5.03 feet; thence N 76°05'50" E, a distance of 50.01 feet; thence N 89°54'40"E, along a line parallel with the South line of the SE 1/4 of said Section 28, a distance of 741.82 feet, to a point on the East line of the SE 1/4 of Section 28; thence S 2°17'26"W, along the East line of the SE 1/4 of said Section 28, a distance of 1425.86 feet, to the point of beginning, aka 30600 Stringtown Road.
Section 2. The preliminary plat "Whippoorwill Place," creating a seven-lot residential subdivision, is hereby approved.
Section 3. The Legislature, pursuant to the application of Charles Carswell (RZ-2002-284), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on November 21, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
