ORDINANCE 3090, November 6, 2000

 

 

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  A conditional use permit for ten years to operate a kennel, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows:

DESCRIPTION:

 

A 6 ± acre tract generally located 1/4 of a mile north of Little Road on the west side of Borgman Road and specifically described:

 

BEGINNING AT THE NORTHEAST CORNER OF THE SOUTHEAST QUARTER OF THE NORTHWEST QUARTER, SECTION 6, TOWNSHIP 49, RANGE 29, JACKSON COUNTY, MISSOURI; THENCE S 0 DEGREES 1 MINUTE 45 SECONDS E ALONG THE  EAST LINE OF SAID QUARTER QUARTER SECTION FOR 330.26 FEET; THENCE N 88 DEGREES 53 MINUTES 17 SECONDS W PARALLEL TO THE NORTH LINE OF SAID QUARTER QUARTER SECTION FOR 792.00 FEET; THENCE N 0 DEGREES 1 MINUTE 45 SECONDS W PARALLEL TO SAID EAST LINE FOR 330.26 FEET TO SAID NORTH LINE; THENCE S 88 DEGREES 53 MINUTES 17 SECONDS E ALONG SAID NORTH LINE FOR 792.00 FEET TO THE POINT OF BEGINNING, CONTAINING 6.00 ACRES MORE OR LESS AND SUBJECT TO THE RIGHT OF WAY OF BORGMAN ROAD, aka 908 S. Borgman Road.

 

 

Section 2.  The conditional use permit granted by this ordinance is subject to the following conditions:

 

1.                     That the number of dogs kept on the property is limited to ten (10).

                                          

2.                     That the kennel shall be private and limited to only the property owner's dogs and shall not be operated as a boarding/commercial animal establishment.

 

3.                     That all dogs must be contained in the residence or the fenced area unless under the control of and obedient to the command of a responsible person.

 

 

Section 3.  The Legislature, pursuant to the application of Peter Drigalla,  (CU-00-050), requesting approval embodied in this ordinance and with notice that the Jackson County Planning Commission unanimously recommended approval of this application in a public hearing on October 19, 2000, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
