BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:
Description: A 114 ± acre tract generally located at the northeast corner of Buckner-Tarsney Road and Hammond Road and more specifically described:
A part of the East half of Section 34, Township 48, Range 30, Jackson County, Missouri described as follows: Beginning at the Southwest corner of the Southeast Quarter of said Section 34; thence North 01 degrees 58 minutes 18 seconds East along the West line of said Southeast Quarter, 670.00 feet; thence South 88 degrees 25 minutes 54 seconds East, 375.00 feet; thence North 01 degrees 58 minutes 18 seconds East, 1318.21 feet; thence South 88 degrees 32 minutes 51 seconds East, 944.08 feet; thence North 01 degrees 58 minutes 44 seconds East, 663.38 feet; thence North 02 degrees 08 minutes 14 seconds East, 663.00 feet; thence South 88 degrees 37 minutes 16 seconds East, 1321.18 feet to a point on the East line of said Section 34; thence South 02 degrees 18 minutes 34 seconds west along the East line of said Section 34, 663.82 feet; thence South 01 degrees 59 minutes 10 seconds West along the East line of said Section 34, 333.64 feet; thence North 88 degrees 30 minutes 07 seconds West, 659.56 feet (Deed=654.36 feet); thence South 01 degrees 58 minutes 57 seconds West, 2322.62 feet to a point on the South line of the Southeast Quarter of said Section 34; thence North 88 degrees 25 minutes 54 seconds West along said South line, 1978.21 feet to the Point of Beginning. Containing 114.21 acres, more or less and subject to any easements.
Section 2. The preliminary plat "Tara," creating a 21-lot residential subdivision and a private street, is hereby approved.
Section 3. The Legislature, pursuant to the application of Valley Enterprises, Inc., (RZ-2000-186), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on March 16, 2000, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
