Body
WHEREAS, the Insurance Commission was created by Ordinance 162 on April 4, 1974, to assist the Cou ty with its insurance needs; and,
WHEREAS, since that time, the County has expanded its Purchasing Department and hired a risk manag r, such that the Legislature believes that the Insurance Commission is no longer necessary; and,
WHEREAS, the Legislature is confident that the County's insurance requirements can be adequately m t, as with nearly all other procurements of goods and services, by the Legislature acting on the r commendations of the administration; and,
WHEREAS, the abolishing of the Insurance Commission will save the County some $18,000.00 per year; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that chapter 76, Jackson Co nty Code, is hereby repealed.
[CHAPTER 76 INSURANCE COMMISSION] [ESTABLISHMENT] [7600. Insurance Commission Created. There is created the Jackson County Insurance Commission.] [MEMBERS] [7610. Number of Members. The Jackson County Insurance Commission consists of three (3) members one of whom is the Presiding Agent.]
[7611. Appointment. The County Executive shall appoint the members of the Commission to staggered three-year terms.]
[7612. Presiding Agent. The Presiding Agent shall be a member of an insurance agency of sufficient size and organization t handle loss claims, the preparation of engineering, rate work and appraisals for insurance compli nce with Jackson County.]
[7613. Duties of Presiding Agent. The Presiding Agent shall maintain all policies and other insurance records of Jackson County.] [7614. Meetings. The Commission shall hold at least one (1) regular meeting monthly.]
[7615. Compensation. Members of the Commission, other than the Presiding Agent, shall be entitled to compensation in th amount of one hundred twenty-five dollars ($125) per month conditional on their attendance at Com ission meetings.]
[7615.1 Limitation on Compensation. No member other than Presiding Agent shall receive more than one hundred twenty-five dollars ($12 ) compensation for attendance during any one calendar month.]
[7615.2 Presiding Agent Compensation. The Presiding Agent shall be entitled to compensation in the amount of twelve hundred fifty dollar ($1250) per month. That compensation shall not be increased to provide staff for the Presiding A ent or the Commission.]
[POWERS_AND_DUTIES] [7620. Insurance Commission, Powers and Duties. The Commission shall have the following powers and duties.]
[7621. Determine Insurance Needs. The Commission shall review all county activities to determine possible insurance needs.]
[7622. Counsel With County Officials. The commission shall counsel with county officials concerning all form of insurance and surety and fidelity bonds purchased or under consideration for purchase by the county.]
[7623. Prepare Specifications. The Commission shall prepare specifications for the submission of bids on all required forms of in urance and surety and fidelity bonds.]
[7624. Assist Director of Purchasing. The Commission shall assist the Director of Purchasing in the solicitation of bids. Bids on insur nce, surety and fidelity bonds by members of the Commission are prohibited. Awards shall be made o the lowest and best bidder in accordance with purchasing procedures established by the county.]
[7624.1 Bidding on Insurance Contracts by Commission Members Prohibited. No commission member shall be awarded an insurance contract let by Jackson County while serving as a member of the Commission.] [7625. Analyze Bids. The Commission shall analyze all insurance bids and submit pertinent details of all proposals toge her with a recommendation for award of insurance contracts to the Manager of the Division of Finan e including a review of the company offering the insurance.]
[7626. Other Powers and Duties. The Commission shall exercise such other powers and duties as may be prescribed by ordinance.]
