Body
WHEREAS, by Resolution 15080, dated July 6, 2004, the Legislature did authorize the County Executive to execute an agreement awarding a term and supply contract under Invitation to Bid No. BB20048 to Bio Environmental Systems Technologies Inc., for use by the Facilities Management Department; and,
WHEREAS, the contract with Bio Environmental System Technologies Inc., was canceled due to non-performance; and,
WHEREAS, Kansas City Air Filter Co., of Kansas City, MO was the only other responsive bid received; and,
WHEREAS, pursuant to Section 1054.6 of the Jackson County Code, 1984, the Director of Purchasing recommends that the term and supply contract awarded under Invitation to Bid No. BB20048, HVAC Filters to Bio Environmental System Technologies, Inc., be rescinded and the award of a five (5) month term and supply contract be made to Kansas City Air Filter Co., of Kansas City, MO; and,
WHEREAS, this award is made on an as needed basis and does not obligate Jackson County to pay any specific amount. The availability of funds for specific purchases is subject to annual appropriations; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that Resolution 15080, dated July 6, 2004, be and hereby is rescinded and the award be made as recommended to Kansas City Air Filter Co., of Kansas City, MO; and,
BE IT FURTHER RESOLVED by the County Legislature of Jackson County, Missouri, that the Director of Purchasing be, and is hereby, authorized to execute for the County any documents necessary to the accomplishment of the award; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to make payments, to the extent sufficient appropriations are available.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
