AN ORDINANCE amending the districts established by the Jackson County Zoning Order by changing from A (Agricultural) to RE (Residential Estates), a certain three ± acre tract.

ORDINANCE # 3305,    October 7,  2002

 

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:

Description:  A 3 ± acre tract generally located 1/4 of a mile west of Old Atherton Road on the north side of Union School Road and specifically described:

 

A tract of land situated in the southeast quarter of Section 9, Township 50 North, Range 31 West, Jackson County, Missouri, more particularly described as follows:

 

Beginning at the southwest corner of said quarter section; thence N 02°14'44"E along the west line of said quarter section a distance of 25.00 feet to a point on the north right of way line of Union School Road, as shown on survey dated July 26, 1989 by Harvey A. Jones, said point being the true point of beginning; thence continuing N 02°14'44"E along said west line a distance of 326.70 feet; thence S 87°36'26"E and parallel to the south line of the southeast quarter of said Section 9 a distance of 400.00 feet; thence S 02°14'44"W on a line 400 feet east of and parallel to the west line of said quarter section a distance of 326.70 feet to a point on said north right of way line; thence N 87°36'26"W along said north right of way line and parallel to the south line of said quarter section a distance of 400.00 feet to the true point of beginning, said tract contains 3.000 acres, more or less, and is subject to all easements and encumbrances of record, aka 20408 E. Union School Road.                                                               

 

Section 2. The Legislature, pursuant to the application of Stanley Wright (RZ-2002-280), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission voted unanimously to recommend this application in a public hearing on September 19, 2002, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
