A RESOLUTION authorizing the County Executive to execute a conveyance instrument transferring Hill Park, a 20 acre neighborhood park located at 23rd and Maywood, in Independence, Missouri, to the City of Independence, Missouri, for the purpose of providing additional recreational opportunities for the residents of the neighborhood.

Body

WHEREAS, the County owns Hill Park, a 20 acre neighborhood park located at 23rd and Maywood in Independence, Missouri, including picnic shelter, restrooms, sand volleyball, playground, two ball fields, and a historic cemetery, legally described as follows:

All of Lots one (1), two (2), three (3), four(4), five (5), six (6), seven (7), eight (8), nine (9), ten (10), eleven (11), twelve (12), thirteen (13), fourteen (14), fifteen (15), sixteen (16), seventeen (17) , eighteen (18), nineteen (19), twenty (20), twenty-one (21), twenty-two (22), twenty-three (23), twenty-four (24), twenty-five (25), twenty-six (26), twenty-seven (27), twenty-eight (28), twenty-nine (29), thirty (30), thirty-two (32), thirty-three (33), thirty-four (34), thirty-five (35), thirty-six (36), thirty-seven (37), thirty-eight (38), and thirty-nine (39) in Glenwood Park, a subdivision of lands in Sections 8 and 9, township forty-nine (49), and Range thirty-two (32), Jackson County, Missouri, as per plat thereof.

 

and,

 

WHEREAS, the neighborhood park serves a population primarily from Independence and will serve as a link to the City's proposed Rock Creek Multi-Use Trail planned for that area; and,

WHEREAS, article II, § 16.25 of the Jackson County Charter authorizes the Legislature to transfer county property to municipalities of the State of Missouri upon terms it deems advantageous to the County; and,

 

WHEREAS, this transaction is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore,

 

BE IT RESOLVED  by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute an appropriate conveyance instrument transferring Hill Park, a 20 acre neighborhood park located at 23rd and Maywood, in Independence, Missouri, to the City of Independence of Independence, MO, in a form to be approved by the County Counselor.

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
