Title
AN ORDINANCE appropriating $338,574.00 from the fund balance of the 2008 Anti-Drug Sales Tax Fund and authorizing the County Executive to execute contracts with certain agencies that engage in community crime prevention activities at an aggregate cost to the County not to exceed $1,063,591.00, and contracts with certain agencies that engage in community crime prevention activities, to supplement the programs provided by the primary prevention agencies, at an aggregate cost to the County not to exceed $169,344.00 both for the purpose of preventing illegal drug use and drug-related activity, authorizing the County Executive to execute an addendum to the contract with the National Council on Alcohol and Drug Dependence for the JAM program in the Jackson County Detention Center, at a cost to the County not to exceed $15,000.00, and authorizing the County Executive to execute an addendum to the contract with Truman Medical Center Behavioral Health for the JAM program, at a cost to the County not to exceed $65,000.00.

Body
WHEREAS, the voters of Jackson County, Missouri, renewed their sales tax for seven years to provide funding for the fight against illegal drugs in our community; and,
WHEREAS, the proceeds and interest generated from this tax are deposited in a special Jackson County Anti-Drug Sales Tax Trust Fund that is segregated and not commingled with the general fund or any other special funds of the County; and,
WHEREAS, the voters and the Legislature authorized contracts with organizations or entities, whether public or private, which engage in community crime prevention activities, for the purpose of preventing drug and drug-related offenses; and,
WHEREAS, the Executive Transition Team, with the assistance of independent consultants, reviewed proposals submitted in response to RFP6-08 by various organizations, and considered staff review and comments thereon; and,
WHEREAS, the organizations listed on the document attached hereto as Exhibit A all have established programs engaging in community crime prevention activities and are otherwise qualified to contract with the County for the expenditure of Anti-Drug Sales Tax Funds; and,
WHEREAS, the County desires to further assist these organizations in the provision of services at the respective costs set forth on Exhibit A, to assist in the prevention of drug and drug-related offenses; and,
WHEREAS, the organizations listed on the document attached hereto as Exhibit B also engage in community crime prevention activities and have either proposed to contract with the County for services to supplement those proposed in their responses to RFP 6-08, or have proposed new prevention programs that the County deems worthy of support; and,
WHEREAS, the County desires to assist these organizations in the provisions of services at the respective costs set forth on Exhibit B, to assist in the prevention of drug and drug-related offenses; and,
WHEREAS, it is also appropriate at this time that the County extend the contracts with the National Association for Alcohol and Drug Dependence, at a cost not to exceed $15,000.00, and Truman Medical Center Behavioral Health, at a cost not to exceed $65,000.00, both for the continued operation of the JAM program at the Jackson County Detention Center; and,
WHEREAS, in order to provide a portion of the funds for these expenditures an appropriation is necessary; and,
WHEREAS, these appropriated funds will also be used to cover the costs of an employment program to operate in conjunction with Drug Court and the costs of new hand-held radios for the Jackson County Drug Task Force; and,
WHEREAS, the County Executive recommends this appropriation; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the fund balance of 2008 Anti-Drug Sales Tax Fund be and hereby is made:

BE IT FURTHER ORDAINED that the County Executive be, and hereby is, authorized to execute agreements with the organizations and in the amounts set forth on the documents attached as Exhibits A and B, in a total amount not to exceed $1,232,935.00, for the purpose of preventing drug and drug-related offenses, in a form to be approved by the County Counselor; and
BE IT FURTHER ORDAINED that the County Executive be and hereby is authorized to execute addenda to the contracts with the National Council on Alcohol and Drug Dependence and Truman Medical Center Behavioral Health, at costs to the County not to exceed $15,000.00 and $65,000.00 respectively, for the operation of the JAM program at the Jackson County Detention Center; and
BE IT FURTHER ORDAINED that the Director of Finance and Purchasing be, and hereby is, authorized to make all payments, including final payments on these agreements.
