A RESOLUTION supporting state legislation to restructure the Board of Trustees of the Little Blue Valley Sewer District and provide for the issuance of district bonds upon the consent of three-quarters (3/4) of the customers of the District.

Body

WHEREAS, Missouri statues currently require that all financing of sewer line improvements by the Little Blue Sewer District be approved by the electors within the District; and,

 

WHEREAS, the District is unique in its stature as a public sewer district because it does not provide services directly to an end user but rather provides its customers, the cities and counties within the District, the ability to serve their citizens and residents; and,

 

WHEREAS, current state law does not provide for the approval of financing techniques through the issuance of bonds or participating in bond fund programs with approval of the customers; and,

 

WHEREAS, it is appropriate that the customers of the District have an opportunity to make improvements to the District through the issuance of bonds with the approval of such customers; and,

WHEREAS, the District is currently governed primarily by a Board of Trustees controlled by the Jackson County; and,

 

WHEREAS, the County is a minor user of the District's services, while the cities in the County are the primary users; and,

 

WHEREAS, since the District desires to allow for this issuance of bonds upon the consent of 3/4 of the cities which are customers of the District, the Legislature believes that it is in the best interests of the County's to modify the make-up of the Board of Trustees to transfer the balance of decision-making authority from the County to the cities; and,

 

WHEREAS, it is of primary importance to the Legislature to ensure that the District continues to provide sewer services to citizens of the County for their health, safety and welfare; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Legislature hereby expresses its support and encourages the adoption of legislation which would amend section 204.300, Revised Statutes of Missouri, as amended, to change the Board of Trustees of the Little Blue Valley Sewer District, from a seven member Board consisting of the County Executive, three members of the mayor's Advisory Board and three members of the County Legislature, to an eight member (or nine member Board if the District extends into an adjacent county) Board consisting of the County Executive, one member of the County Legislature, the Mayors of the four cities constituting the largest users of flow during the previous fiscal year and two additional Mayors from the Mayor's Advisory Board, all as more specifically set forth in the attachment; and,

 

BE IT FURTHER RESOLVED that the Legislature hereby also expresses its support and encourages the adoption of legislation which would amend section 204.370(1), Revised Statutes of Missouri, as amended, to provide for the issuance of district bonds upon the consent of three-quarters (3/4) of the customers of the District, as more specifically set forth in the attachment.

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
