BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:
Description: A 38.3 ± a tract generally located south of Blue Mills Road, east of Elsea Smith Road and north of Rogers Road and specifically described as:
A TRACT OF LAND BEING PART OF THE NE 1/4 SECTION 7-T.50-R.30 AND ALL OF MISSIONARY BRANCH, A SUBDIVISION, ALL IN JACKSON COUNTY, MISSOURI DESCRIBED AS FOLLOWS: BEGINNING AT THE SW CORNER OF A TRACT OF LAND RECORDED IN BOOK I-1225 AT PAGE 579, SAID CORNER BEING N 87̊-30'-23" W, ALONG THE SOUTH LINE OF SAID NE 1/4, 986.70 FEET FROM THE SE CORNER OF SAID NE 1/4; THENCE N 87̊-30'-23"W, CONTINUING ALONG SAID SOUTH LINE, 1115 FEET TO A POINT ON THE CENTERLINE OF ELSEA SMITH ROAD, SAID POINT BEING S 87̊-30'-23"E, ALONG THE SOUTH LINE OF SAID NE 1/4, 520.68 FEET FROM THE SW CORNER OF SAID NE 1/4, SAID POINT BEING ALSO THE SW CORNER OF SAID MISSIONARY BRANCH; THENCE NORTHWESTERLY, ALONG THE CENTERLINE OF SAID ELSEA SMITH ROAD, ALONG A CURVE TO THE LEFT HAVING A RADIUS OF 287.94 FEET AND AN INITIAL TANGENT BEARING OF N 48̊-59'-59"W, AN ARC DISTANCE OF 7.83 FEET; THENCE N 50̊-33'-25"W, CONTINUING ALONG SAID CENTERLINE, 38.80 FEET; THENCE NORTHERLY, CONTINUING ALONG SAID CENTERLINE, ALONG A CURVE TO THE RIGHT HAVING A RADIUS OF 287.94 FEET AND TANGENT TO THE LAST DESCRIBED COURSE, AN ARC DISTANCE OF 224.72 FEET; THENCE N 05̊-50'-25"W, CONTINUING ALONG SAID CENTERLINE, 887.40 FEET TO THE CENTERLINE OF BLUE MILLS ROAD; THENCE S 89̊-13'-20"E, ALONG SAID CENTERLINE, 159.39 FEET; THENCE NORTHEASTERLY, CONTINUING ALONG SAID CENTERLINE, ALONG A CURVE TO THE LEFT HAVING A RADIUS OF 1432.39 FEET AND TANGENT TO THE LAST DESCRIBED COURSE, AN ARC DISTANCE OF 509.17 FEET; THENCE N 71̊-21'-50"E, CONTINUING ALONG SAID CENTERLINE, 368.15 FEET; THENCE NORTHEASTERLY, CONTINUING ALONG SAID CENTERLINE, ALONG A CURVE TO THE LEFT HAVING RADIUS OF 1421.39 FEET AND TANGENT TO THE LAST DESCRIBED COURSE, AN ARC DISTANCE OF 508.79 FEET; THENCE S 04̊-34-'50"W, ALONG THE WEST LINE OF THE TRACT RECORDED IN SAID BOOK 8-1225 AND ITS NORTHERLY PROLONGATION, 1589.82 FEET TO THE POINT OF BEGINNING.
Section 2. The preliminary plat "Rogers Ridge," creating a seven-lot residential subdivision, is hereby approved.
Section 3. The Legislature, pursuant to the application of Allen Owings (RZ-2003-291), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on February 20, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
