AN ORDINANCE granting a conditional use permit (CUP) in District A (Agricultural) for a period of three (3) years to operate a child day care center on a 20 ± acre tract .

Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
 
Section 1.  A conditional use permit (CUP) is hereby granted for a period of three (3) years to operate a child day care center as to an approximate 20 + acre tract located ½ + mile north of Pink Hill Road on the west side of Outer Belt Road (H Highway) legally described as follows:
Description: The south 20 acres, more or less, of the southeast quarter of the northeast quarter of Section 17, Township 49 North, Range 29 West, in Jackson County, Missouri, aka 3014 South Outer Belt Road.
 
Section 2.  The CUP granted by this Ordinance is subject to the following conditions:      
1.        All conditions contained within Section 25005.6 of the Unified Development Code, relating to Child Day Care Centers be complied with.
      
2.        The applicant submit copies of all licenses from the Missouri Department of Health - Bureau of Child Care as well as annual renewals to Public Works - Planning and Development Division.
      
3.        The Child Day Care Center shall be limited to the maximum number of children permitted by the Missouri Department of Health.
 
4.       The outdoor play area of the Child Day Care Center shall be enclosed with a fence, which shall be built and maintained to a minimum height of four (4) feet.  Children should have a direct, safe access from the building into the outdoor play area.      
 
5.       The existing free-standing sign can not be enlarged and must remain unobtrusive and unilluminated displaying only the name of the business, situs address, and hours of operation.
 
6.       The Child Day Care Center shall operate only between the hours of 6:00 am and 6:30 pm, Monday through Friday.
 
 
Section 3.  The Legislature, pursuant to the application of the Betty Morrison (CU-2008-201), requesting approval embodied in this Ordinance and with notice that the Jackson County Plan Commission  voted unanimously to recommend approval of this application in a public hearing on June 19, 2008, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
 
Enacted and Approved
Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
