BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:
Description: A 70 ± acre tract of land generally located east of Gammon Road and south of Lone Jack-Lee's Summit Road and U.S. Highway 50 and more specifically described:
All that part of the Southeast Quarter of Section 16, Township 47 North, Range 30 West, all in Jackson County, Missouri and being more fully described as follows:
Beginning at a point on the East Right of Way line of R.F. Gammon Road a county Road, said point being 790.65 feet North and 20.01 feet East of the Southwest corner of the Southeast Quarter of Section 16, Township 47 North, Range 30 West; thence North 02 degrees 09 minutes 00 seconds East along said Right of Way, 1376.32 feet; thence South 89 degrees 45 minutes 17 seconds East, 335.76 feet; thence North 02 degrees 09 minutes 00 seconds East, 466.86 feet to a point on the South right of Way line of Lone Jack-Lee's Summit Road (Old 50 Highway); thence along South Right of Way, 1030.26 feet, to a point on the Southwesterly Right of Way of U.S. 50 Highway; thence South 67 degrees 09 minutes 31 seconds East along said Southwesterly Right of Way, 838.69 feet; thence South 02 degrees 03 minutes 19 seconds West, 612.66 feet; thence North 89 degrees 52 minutes 29 seconds West, 949.53 feet; thence South 02 degrees 03 minutes 19 seconds West, 818.31 feet; thence North 89 degrees 52 minutes 29 seconds West, 436.88 feet; thence North 43 degrees 51 minutes 45 seconds West 63.07 feet to a point on a curve having a Radius of 280.00 feet and an initial tangent bearing of South 39 degrees 59 minutes 17 seconds West: thence along said curve to the right an arc length of 245.02 feet to a point of tangent; thence North 89 degrees 52 minutes 29 seconds West, 510.37 feet to the point of beginning.
Section 2. The preliminary plat "Country Summit Estates," creating an eleven-residential and one-commercial lot subdivision, is hereby approved.
Section 3. The Legislature, pursuant to the application of David Carpenter (RZ-2001-247), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on August 16, 2001, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
