AN ORDINANCE appropriating $5,600.00 from the unappropriated surplus of the 2003 Federal Forfeiture Fund and awarding a term and supply contract for the furnishing of Westlaw on-line publishing and records services for use by the Prosecuting Attorney's Office to West Group of Carol Stream, IL, at an estimated cost to the County of $5,600.00, as a sole source purchase.

Body
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $5,000.00; and,
WHEREAS, the Purchasing Director recommends a contract with West Group of Carol Stream, IL, for the furnishing of Westlaw on-line publishing and records services for use by the Prosecuting Attorney's Office to provide for departmental needs for the upcoming eight-month period; and,
WHEREAS, the Purchasing Director further recommends that he not take competitive bids with regard to said contract for the reason that West Group of Carol Stream, IL, is the only known supplier of its own proprietary Westlaw on-line publishing and records services; and,
WHEREAS, in order to fund this expenditure, an appropriation is necessary; and,
WHEREAS, the County Executive recommends said appropriation as an amendment to her 2003 proposed County budget; now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, that the following appropriation from the unappropriated surplus of the 2003 Federal Forfeiture Fund be and hereby is made:

BE IT FURTHER ORDAINED that award be made as recommended by the Purchasing Director, and that the Purchasing Director be, and is hereby, authorized to execute for the County a contract with West Group of Carol Stream, IL; and,
BE IT FURTHER ORDAINED that the Director of the Department of Finance is authorized to make all payments including final payment on the contract, to the extent sufficient appropriations to the using spending agency have heretofore been made in the current Jackson County budget.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
