Body
WHEREAS, case number 2516-CV21560 was filed on July 9, 2025, which names the Jackson County Legislature, the County Executive, and the County Clerk as defendants; and,
WHEREAS, case number 2516-CV21738 was filed on July 9, 2025, which names the Clerk of the Jackson County Legislature, and the Jackson County Executive as defendants; and,
WHEREAS, the Jackson County Counselor is conflicted out of representing the various County defendants under the Missouri Rules of Professional Conduct; and,
WHEREAS, 2516-CV21560 is a writ of mandamus proceeding, and a request has been made by plaintiffs to expedite the proceedings; and,
WHEREAS, 2516-CV21738 is a verified petition for declaratory and injunctive relief; and,
WHEREAS, in 2516-CV21560 the Legislature and Clerk were dismissed as parties, however questions remain as to whether they will intervene in the action.
WHEREAS, the Jackson County Legislature has sought representation for itself in this matter and informally reviewed the qualifications of competent attorneys and law firms; and,
WHEREAS, the Chair of Jackson County Legislature, in consultation with other Legislators, has selected Patrick McInerney of the Spencer Fane Law Firm of Kansas City, MO to represent Jackson County Legislature in this matter; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Jackson County Legislature be and hereby is authorized to execute a limited Legal Services Agreement with Patrick McInerney of the Spencer Fane Law Firm of Kansas City, MO, for representation in 2516-CV21560 and 2516-CV21738 and at a cost to the County not to exceed $60,000.00; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance and Purchasing be and hereby is authorized to make all payments, including final payment on the Agreement, to the extent that sufficient appropriations are contained in the then-current County budget.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
