WHEREAS, the U.S. Army Corps of Engineers and the County did enter into Lease No. DACW41-1-89-181 for the period of May 9, 1990, through May 8, 2040, for the development of Blue Springs Lake for public parks and recreational purposes; and,
WHEREAS, U.S. Army Corps of Engineers, by document no. DACW41-2-84-14, previously granted the County an easement for the installation, operation, and maintenance of a communications tower within the boundaries of the lease area, which expired on August 16, 2009; and,
WHEREAS, the U.S. Army Corps of Engineers recommends the execution of the attached Supplemental Agreement No. 1 to Lease No. DACW41-1-89-181 for the purpose of adding the communications tower to the existing lease agreement; and,
WHEREAS, the communications tower contains antennas and equipment utilized by the Park Safety and Enforcement Division of the Parks and Recreation Department, the Public Works Department, and the Missouri Water Patrol; and,
WHEREAS, the execution of the attached Supplemental Agreement to Lease No. DACW41-1-89-181 is in the best interest of the health, welfare, and safety of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the attached Supplemental Agreement to Lease No. DACW41-1-89-181 is hereby approved and that the County Executive is hereby authorized to execute on behalf of the County the Agreement and any other documents necessary to give effect to this Resolution.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
