BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District, so that there will be transferred from District A to District RR, a tract of land described as follows:

Description:

 

The 5 ± acres are located approximately ½ ± mile west of Koger Road on the north side of Blue Mills Road and specifically described as:  All that part of the Southeast Quarter of Section 12, Township 50, Range 31 Jackson County, Missouri, being more particularly described as follows: 

 

Commencing at the Northwest corner of the Southeast Quarter of said Section 12; thence along the North line of said Quarter Section, South 88 degrees, 27 minutes, 20 seconds East, 1085.94 feet to the POINT OF BEGINNING; thence continuing along the North line of said Quarter Section, South 88 degrees, 27 minutes, 20 seconds East, 283.18 feet; thence parallel to the Northeast line of a tract of land described by Document No. I-245698, South 19 degrees, 55 minutes, 10 seconds East, 772.76 feet to a point on the Northwest Right-of-Way line of Blue Mills Road (40 feet from the center line thereof); thence along the Northwest Right-of-Way line of said Blue Mills Road (40 feet from the center line thereof), in a Southwesterly direction, along a curve to the right (having an initial tangent bearing of South 66 degrees, 36 minutes, 31 seconds West and a radius of 1105.73 feet), 67.00 feet to a point of tangent; thence continuing along the Northwest Right-of-Way line of said Blue Mills Road (40 feet from the center line thereof), South 70 degrees, 04 minutes, 50 seconds West, 196.58 feet; thence parallel to the Northeast line of said tract of land described by Document No. I-245698, North 19 degrees, 55 minutes, 10 seconds West, 878.41 feet to the POINT OF BEGINNING, containing 5.000 acres more or less.

 

 

Section 2.  The Legislature, pursuant to the application of Gatti Properties, LLC (John J. Gatti) (RZ-2006-409), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application at a public hearing on September 21, 2006, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
