AN ORDINANCE granting a conditional use permit (CUP) in District A (Agricultural) in perpetuity for a family cemetery on a 1,500 ± square foot tract of land, subject to conditions.

Body
BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. A conditional use permit for a family cemetery.

WHEREAS, a tract of land 1,500± square foot tract of land generally located 1/10 of a mile north of Hillside School Road (28th Street) and approximately 700 feet east of Cemetery Road and specifically described as follows:
A tract of land located in the north ½ of range 29 in Jackson County, Missouri, being more particularly described as follows: commencing at the Northwest corner of the Northeast quarter of said Section 8: thence south 01 degree, 57 minutes, 38 seconds West along the East line of the Northeast quarter of said Section 8, a distance of 616.78 feet to the intersection of the West line of said quarter section with the westerly prolongation of a fence line; thence, South 88 degrees, 13 minutes, 27 seconds East along said fence line and the westerly prolongation thereof, 692.96 feet to the true point of beginning; thence, North 01 degrees, 46 minutes, 33 seconds East, 26.79 feet; thence South 88 degrees, 13 minutes, 27 seconds East, 56.00 feet to the point of beginning, containing 15000 square feet, more or less, except that part in roads or highways, and being subject to all rights-of-way, easements, conditions, restrictions and reservations, now of record.

and,

WHEREAS, the Jackson County Plan Commission, on January 20, 2005 held a public hearing and accepted testimony pertaining to the conditional use permit requested by Walter Reed and Lois Reed. This request for a family cemetery will not seriously injure the appropriate use of neighboring property and conforms to the general intent and purpose of the Unified Development Code. Therefore, the Plan Commission voted 8 to 0 to recommend Approval in Perpetuity, provided the following four (4) conditions are met:
This cemetery shall be considered a family burial ground defined as a cemetery in which no burial space is sold to the public and in which interments (burials) are restricted to persons related by blood or marriage.
The dimension for each grave site will be four (4) feet by ten (10) feet in area.
The depth of the grave will be a minimum of five (5) feet from the ground level.
A casket will be encased in a concrete grave liner that will be permanently installed in each grave.

BE IT ORDAINED by the County Legislature of Jackson County, Missouri that a conditional use permit be granted subject to the four (4) conditions set forth immediately above.

Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
