Body
WHEREAS, article XIV, section 2.6(5) of the Missouri Constitution authorizes the governing body of a county to impose a countywide sales tax on all tangible personal property retail sales of adult use non-medicinal marijuana sold in such county; and,
WHEREAS, article XIV, section 2.6(5) provides that the tax authorized by this section shall be in addition to any and all other sales taxes allowed by law, except that no ordinance or order imposing a sales tax shall be effective unless the governing body of the county submits to the voters of the county, at a county or state general, primary, or special election, a proposal to authorize the governing body of the county to impose the tax; and,
WHEREAS, the Legislature has determined and does now find and determine that a ballot question should be submitted to the voters of Jackson County to authorize imposition of countywide sales tax on all tangible personal property retail sales of adult use, non-medicinal marijuana; and,
WHEREAS, the submission to the voters of a question authorizing a three percent sales tax on the retail sale of adult use, non-medicinal marijuana, is in the best interests of the health, welfare, and safety of the citizens of Jackson County, now therefore,
BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows:
Section 1. Pursuant to the provisions of article XIV, section 2.6(5) of the Missouri Constitution, there is hereby submitted to the qualified voters of Jackson County, Missouri, at a special election to be held on April 4, 2023, a question authorizing Jackson County to levy a countywide sales tax at the rate of three percent on all tangible personal property retail sales of adult use, non-medicinal marijuana in the County.
Section 2. The qualified voters at said election shall vote by ballot and the ballots to be used at said election shall contain the following language:

Shall Jackson County, Missouri, be authorized to impose a countywide sales tax of three percent (3%) on all tangible personal property retail sales of adult use, non-medicinal marijuana sold in Jackson County, for the exclusive purpose of funding, through a special revenue fund, services for violent crime prevention, community health, veterans support, and community preservation?

Section 3. The Clerk of the Legislature is hereby authorized and directed to notify the Jackson County and Kansas City Boards of Election Commissioners of the adoption of this Ordinance no later than 5:00 p.m. on January 24, 2023, and to include in said notification all of the terms and provisions required by § 115.125, RSMo 2016.

Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
