Body

WHEREAS, on November 7, 2006, the voters adopted an amendment to article 6, section 6.1 of the Missouri Constitution regarding property tax exemptions; and,

 

WHEREAS, this amendment authorized the General Assembly to enact legislation that would exempt real and personal property, not held for private or corporate profit, and used exclusively for veterans' organizations, from ad valorem property taxation; and,

 

WHEREAS, the General Assembly, in its 2007 Regular Session, enacted House Bill 654, which wrote into law such an exemption; and,

 

WHEREAS, the Assessment Department has identified ten properties owned by eligible veterans' organizations, primarily the Veterans of Foreign Wars and American Legion, and operated for their own use, which have previously have been partially or fully taxable; and,

 

WHEREAS, the Assessment Department has advised that it intends to fully exempt from taxation all of these parcels for the 2007 tax year; and,

WHEREAS, this policy, as announced by the Assessment Department, is consistent with the Legislature's intent that the constitutional and statutory amendments be given full effect for the 2007 tax year; now therefore,

 

BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Legislature hereby does hereby express its intent that the Assessment Department give full effect to article X, section 6.1 of the Missouri Constitution and section 137.100 (9), RSMo (House Bill 654, Laws 2007), relating to the taxation of property owned by veterans' organizations, for the 2007 tax year; and,  

 

BE IT FURTHER RESOLVED that the Legislature does hereby commend the Assessment for its announced plan consistent with this intent.

 

 

Enacted and Approved

Effective Date:  This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
