BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:

Description:

 

The 10.1 ± acres are approximately ¼ ± mile east of Buckner Tarsney Road on the south side of Pink Hill Road and specifically described as all that part of the North Half of the Northwest Quarter of the Northeast Quarter of Section 23, Township 49, Range 30 in Jackson County, Missouri described as follows: 

 

Commencing at the northwest corner of said quarter quarter section; thence South 88 degrees 36 minutes 04 seconds East along the north line of said quarter quarter section, a distance of 732.29 feet to the northwest corner of TURNER'S CORNER, a subdivision of Record; thence South 01 degrees 30 minutes 21 seconds West along the west line of said subdivision, a distance of 58.00 feet to a point on the south right-of-way line of Pink Hill Road as established, said point being the POINT OF BEGINNING; thence continuing South 01 degrees 30 minutes 21 seconds West along said west line, a distance of 603.05 feet to the southwest corner thereof, said being on the south line of said North Half of the Northwest Quarter of the Northeast quarter of Section 23; thence North 88 degrees 34 minutes 18 seconds West along said south line, a distance of 731.88 feet to a point on the west line of said quarter section; thence North 01 degrees 28 minutes 14 seconds East along said west line, a distance of 602.68 feet to a point on said south right-of-way line of Pink Hill Road; thence South 88 degrees 36 minutes 04 seconds East along said south right-of-way line, a distance of 732.25 feet to the POINT OF BEGINNING aka 33409 E. Pink Hill Road.

 

Section 2.  The Legislature, pursuant to the application of Kevin Sterrett on behalf of the property owner Homer Turner (RZ-2007-422), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application at a public hearing on January 18, 2007, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
