IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title AN ORDINANCE repealing §§1531. and 1532., and 1533., Jackson County Code, 1984, relating to the Jackson County Employees' Pension Plan, and enacting, in lieu thereof, two new sections relating to the same subject. Intro ORDINANCE 2639, February 24, 1997 INTRODUCED BY John Patrick Burnett, County Legislator Body WHEREAS, in the 1997 Jackson County budget, the County has, for the first time, made available funds to provide a death benefit for unmarried employees who are vested in the County's pension plan; and, WHEREAS, the Pension Plan Administration Committee has recommended that the Plan be amended to provide this benefit ; and, WHEREAS, under the proposed amendment, unmarried employees who are vested in the Plan will now be able to designate a survivor to receive a lump sum death benefit, which had previously been available only to spouses of married employees; and, WHEREAS, the proposed amendment is in the best interests of the health, welfare, and safety of the citizens of Jackson County; now therefore, BE IT ORDAINED by the County Legislature of Jackson County, Missouri, as follows: Section A. Enacting Clause. Section 1531., 1532., and 1533., Jackson County Code, 1984 are hereby repealed and two new sections enacted in lieu thereof, to be known as sections 1532. and 1533., to read as follows: 1531. [Death Prior to Age 55 and No Spouse, Effect. If an active Member should die (i) before reaching Attained Age fifty-five (55) and (ii) without being survived by a Spouse (regardless of his Attained Age and years of Service), no Death Benefit shall be payable under this Plan.] RESERVED 1532. [Death Prior to Age 55 With Spouse, Effect. If any active member should die (i) before reaching Attained Age fifty-five (55), (ii) being Vested in the Plan, and (iii) being survived by a Spouse, his Spouse shall be entitled to a Death Benefit. No Death Benefit shall be payable if the Member is not survived by a Spouse. Such Death Benefit shall be a lump sum payment in an amount equal to the deceased Member's Current Accrued Benefit at the time of death.] Death, Effect. Except as specifically provided in 1533. of this chapter, if any active Member should die being Vested in the Plan, a lump sum Death Benefit equal to the deceased Member's Current Accrued Benefit at the time of death shall be payable: (i) to the deceased Member's surviving Spouse, if any; (ii) if the deceased Member is not survived by a Spouse, to such other survivor as the deceased Member has designated; or (iii) if the deceased Member has made no such designation, to the deceased Member's estate. 1533. Death After Age 55 With Spouse, Effect. If any active Member should die (i) after reaching Attained Age fifty-five, (ii) being Vested in the Plan, and (iii) be survived by a Spouse, [his] that Spouse shall be entitled to a Death Benefit. No Death Benefit shall be payable if the Member is not survived by a Spouse. Such Death Benefit shall be a monthly income, payable for the life of the Spouse equal to the benefit that would have been payable to such Spouse if the Member had retired on the day before [his] the date of death and elected the form of payments specified in Section 1511.2 with 100% of [his] the reduced benefits continued to [his] the Member's Spouse for lifetime. Such Spouse Death Benefit payments shall commence on the first day of the month next following the Member's date of death. Notwithstanding the above, if a Member had reached [his] the Member's Normal Retirement Date and had made a written election as to the form of benefit payments pursuant to Section 1511, then, upon [his] the Member's death prior to the commencement of benefits, any Death Benefit shall be payable in accordance with such written election. [If such a deceased Member had elected that his benefit be payable in the form specified in Section 1511.1 and he is survived by a Spouse, the Death Benefit provided in this Section 1532 shall nonetheless be payable to his Spouse.]Attorney Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
