BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District, so that there will be transferred from District A to District RR, a tract of land described as follows:
Description:
The 10.3 ± acres are generally located 1/2 ± mile north of U.S. Highway 50 on the west side of Al Gossett Road and specifically described as all that part of the Northwest Quarter of the Northeast Quarter of Section 21, Township 47 North, Range 29 West, situated in Jackson County, Missouri and being more particularly described as follows: Commencing at the Southeast corner of said quarter quarter section; thence North 02̊ 29' 07" East along the East line of said quarter quarter section a distance of 344.76 feet to the point of beginning; thence North 87 ̊ 37' 52" West a distance of 1348.90 feet to the West line of said quarter quarter section, (Found 1/2" iron bar); thence North 02̊ 21' 14" East along said West line a distance of 332.55 feet (Found 3/8" iron bar); thence South 87̊ 43' 29" East, (South 89̊ 43' 47" West Deed), a distance of 1349.67 feet, (1349.40 feet Deed), to the East line of said quarter quarter section; thence South 02̊ 29' 07" West along said East line a distance of 328.76 feet to the point of beginning. Containing 450,196 square feet more or less, except that part in the public road, aka 13210 Al Gossett Road.
Section 2. The Jackson County Plan Commission, on June 16, 2005 held a public hearing and accepted testimony pertaining to the change of zoning requested by Leonard and Joyce DeVader. This request is consistent with the intent and purpose of the Master Plan, therefore, the Plan Commission voted 8 to 0 to recommend APPROVAL to the County Legislature.
Section 3. The Legislature, pursuant to the application of Leonard and Joyce DeVader (RZ-2005-371), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended APPROVAL of this application in a public hearing on June 16, 2005, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
