WHEREAS, there are now pending in the Circuit Court of Jackson County, Missouri, the cases of Laura Sambursky, et al. v. Jackson County, Missouri, and Sandra Marie Graham v. Jackson County, Missouri, Case Nos. CV92-10222 and CV-10223, wherein the plaintiffs seek damages against Jackson County, Missouri, relative to wrongful death and personal injuries; and,
WHEREAS, the Jackson County Counselor has recommended that it is in the best interest of the health, welfare, and safety of the citizens of Jackson County that all of the plaintiffs' claims (including a third-party counterclaim by one Julian Andrus as next friend for Kelly B. Andrus) against the County be settled for the payment of $125,000.00 to plaintiffs, as more specifically explained and detailed to the Jackson County Legislature by the County Counselor in closed session related to this litigation; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Counselor be, and hereby is, authorized to settle the cases of Laura Sambursky, et al. v. Jackson County, Missouri, and Sandra Marie Graham v. Jackson County, Missouri, Case Nos. CV92-10222 and CV92-10223, in the Circuit Court of Jackson County, Missouri, for a total payment of $125,000.00, in full, final, and complete release of Jackson County, Missouri, and all of its employees, officers, agents, and servants; and,
BE IT FURTHER RESOLVED that the Manager of the Division of Finance is authorized to issue the check or checks of Jackson County, Missouri in the total amount of $125,000.00 to plaintiffs pursuant to instructions of the Jackson County Counselor.
Attorney Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
