BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:
Description: The 28 ± acres is generally located 600 feet north of Missouri Route FF (Truman Road) on the east side of Borgman Road lying in the southeast quarter of Section 7, Township 49, Range 29 in Jackson County, Missouri and specifically described:
COMMENCING at the Southeast corner of the Southeast Quarter of said Section 7; thence North 1̊13'13" East, along the East line of said Southeast Quarter Section, a distance of 697.27 feet; thence North 87̊11'26" West, a distance of 670.63 feet to the POINT OF BEGINNING; thence South 1̊21'39" West, a distance of 38.16 feet; thence North 89̊08'18" West, a distance of 620.00 feet a point on the East right of way line of Borgman Road, as it presently exists; thence North 1̊21'39" East, along said right of way, being 40.00 feet East of and parallel with the West line of the East One-half of said Southeast Quarter Section, a distance of 1967.00 feet to a point on the North line of said Southeast Quarter Section; thence South 88̊34'39" East, along the North line of said Southeast Quarter Section, a distance of 619.97 feet; thence South 1̊21'39" West, a distance of 1922.77 feet to the POINT OF BEGINNING, containing 27.952 acres, more or less.
Section 2. The preliminary plat "Truman Estates 2nd Plat," creating a five-lot residential subdivision, is hereby approved.
Section 3. The Legislature, pursuant to the application of BS Builders, Inc. (RZ-2003-303), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on May 15, 2003, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
