AN ORDINANCE amending the zoning districts established by the Unified Development Code by rezoning a certain 9 ± acres from District A (Agricultural) to District RE                (Residential Estates) for a three-lot residential subdivision.

Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

                                                                                                         

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:

Description:

 

A 9 ± acre tract of land located at the northeast corner of Missouri 150 Highway and Harris Road and more specifically described as the South ½ of the South 41 acres of the East 82 acres of the SE ¼ of section 25, T47N, R31W, in Jackson County, Missouri, except that part lying Southeasterly of the Southerly right of way line of Missouri Highway 150 and except that part in the East ½ of the SE ¼ of the SE ¼ of said section 25 that lies Northerly of the Northerly right of way line of said highway and except that part in said road, subject to easements, restrictions, and rights of way.

 

Section 2.  The Jackson County Plan Commission, on October 20, 2005 held a public hearing and accepted testimony pertaining to the change of zoning requested by Karen Sinco.  This request is consistent with the intent and purpose of the Master Plan, therefore, the Plan Commission voted 6 to 1 to recommend APPROVAL to the County Legislature.  

 

Section 3.  The Legislature, pursuant to the application of Karen Sinco (RZ-2005-373), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission voted 6 to 1 to recommend APPROVAL of this application in a public hearing on October 20, 2005, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
