Body
WHEREAS, by Ordinance 3605, dated February 22, 2005, award was made to Radmacher Brothers Excavation of Pleasant Hill, MO, on Bid No. PW 13-2004, for the Colbern Road Phase III Project, No. 2455; and,
WHEREAS, proposed Change Order No. 1 to this contract, a copy of which is attached hereto and incorporated herein by reference, is necessary to make the final adjustments from plan quantities to as-built quantities, and said change order will result in a decrease to the contract of $24,187.77; and,
WHEREAS, all work contemplated by the original contract has been completed and is fully acceptable to the County; and,
WHEREAS, it is appropriate that the Director of Finance and Purchasing issue final payment to Radmacher Brothers Excavation, in the amount of $100.00; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute Change Order No. 1 with Radmacher Brothers Excavation of Pleasant Hill, MO, for the Colbern Road Phase III Project, No. 2455; and,
BE IT FURTHER RESOLVED that the Director of Finance and Purchasing be and hereby is authorized to make final payment on the contract and unencumber the contract balance of $24,187.77.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
