BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District so that there will be transferred from District A to District RE a tract of land described as follows:
Description: A 7.7 ± acre tract of land generally located south of Fristoe Road, north of Harris-Potts Road and west of Buckner Tarsney Road and more specifically described as:
A TRACT OF LAND LOCATED IN THE NORTHEAST QUARTER OF SECTION 22, TOWNSHIP 48, RANGE 30 IN JACKSON COUNTY, MISSOURI AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHEAST CORNER OF SECTION 22, TOWNSHIP 48, RANGE 30 AS DESCRIBED IN MISSOURI LAND SURVEY DOCUMENT NO. 600-56228; THENCE NORTH 86 DEGREES, 18 MINUTES, 13 SECONDS WEST, 658.85 FEET ALONG THE NORTH LINE OF SAID SECTION 22 TO A POINT OF INTERSECTION WITH THE WESTERLY RIGHT OF WAY LINE OF JACKSON COUNTY ROAD 20-E AS NOW ESTABLISHED (ALSO DESIGNATED AS BUCKNER-TARSNEY ROAD), SAID POINT ALSO BEING THE TRUE POINT OF BEGINNING OF THIS DESCRIPTION; THENCE IN A SOUTHWESTERLY DIRECTION ALONG SAID WESTERLY RIGHT OF WAY LINE, BEING ON A CURVE TO THE LEFT, HAVING A RADIUS OF 2904.99 FEET AND A DELTA ANGLE OF 10 DEGREES, 27 MINUTES, 12 SECONDS, AN ARC DISTANCE OF 530.00 FEET TO THE POINT OF TANGENT OF SAID CURVE; THENCE SOUTH 17 DEGREES, 39 MINUTES, 24 SECONDS WEST, 159.68 FEET ALONG THE SAID WESTERLY RIGHT OF WAY LINE TO A POINT OF INTERSECTION WITH THE SOUTH LINE OF THE NORTH 20.014 ACRES OF THE NORTHEAST QUARTER OF SAID SECTION 22; THENCE NORTH 86 DEGREES, 34 MINUTES, 57 SECONDS WEST, 401.89 FEET ALONG THE SOUTH LINE OF THE SAID NORTH 20.014 ACRES OF SAID SECTION 22 TO A POINT ON THE WEST LINE OF THE NORTHEAST QUARTER OF SAID SECTION 22; THENCE NORTH 01 DEGREES, 41 MINUTES, 35 SECONDS WEST, 659.70 FEET TO THE NORTHWEST CORNER OF THE NORTHEAST QUARTER OF SAID SECTION 22; THENCE SOUTH 86 DEGREES, 18 MINUTES, 13 SECONDS WEST, 676.32 FEET TO THE TRUE POINT OF BEGINNING OF THIS DESCRIPTION. THE ABOVE DESCRIBED TRACT OF LAND CONTAINS 7.743 ACRES EXCLUSIVE OF ROAD RIGHT OF WAY AND IS SUBJECT TO ROAD RIGHT OF WAYS, EASEMENTS AND RESTRICTIONS OF RECORD, IF ANY. AKA 32003 E. FRISTOE ROAD.
Section 2. The Legislature, pursuant to the application of Charles Colston, III (RZ-2001-230), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on April 19, 2001, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
