Body
WHEREAS, by Resolution 19023, dated December 1, 2015, the Legislature did authorize the execution of a Cooperative Agreement with the Kansas City Area Transportation Authority (KCATA) related to the acquisition of the Rock Island Rail Corridor (RIRC); and,
WHEREAS, section 3.3 of the Cooperative Agreement expressed the intent of both parties to negotiate and agree regarding the management and maintenance of the RIRC; and,
WHEREAS, the City of Lee’s Summit desires to make certain improvements to Chipman Road along the Rock Island Corridor right of way, which necessitate the removal of the single lane arch railroad bridge over Chipman Road; and,
WHEREAS, the City will pay the County $2 million to remove this bridge, to be credited to the County’s General Fund; and,
WHEREAS, the County’s construction of the shared use path along the RIRC, in particular at-grade crossings, also requires certain permits and licenses from the City of Lee’s Summit; and,
WHEREAS, the proposed Cooperative Agreement contains provisions that address both issues; and,
WHEREAS, the execution of this Cooperative Agreement is in the best interest of the health, safety, and welfare of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and is hereby authorized to execute the attached Cooperative Agreement with the City of Lee’s Summit, MO.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
