Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

 

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:

Description:

                     

A 45.4 + acre tract of land generally located at the northwest corner of Easley Road and Alley-Jackson Road and specifically described as follows:

 

A part of Section 9, Township 47, Range 30, Jackson County, Missouri described as follows: Commencing at the Southeast corner of the Southwest Quarter of the Northeast Quarter of Section 9; thence South 89 degrees, 32 minutes, 38 seconds, West along the South line of the Northeast Quarter, 120.00 feet to the Point of Beginning; thence South 01 degrees, 35 minutes, 02 seconds West, 1.51 feet to a point on the existing North right-of-way line (20.00 feet North of centerline as now established); thence South 86 degrees, 40 minutes, 42 seconds West along said line, 989.28 feet to a point of curvature; thence continue along said line and a curve to the right having a Radius of 3354.04 feet and a distance of 223.43 feet; thence continue along said line North 89 degrees, 22 minutes, 41 seconds West, 531.30 feet; thence North 01 degrees, 35 minutes, 02 seconds East, 669.00 feet; thence South 89 degrees, 47 minutes, 46 seconds East, 991.53 feet; thence North 01 degrees, 35 minutes, 02 seconds East, 750.85 feet to a point of curvature; thence along said curve having a Radius of 100.00 feet and a distance of 64.30 feet; thence North 53 degrees, 09 minutes, 29 seconds West, 69.25 feet; thence North 01 degrees, 35 minutes, 02 seconds East, 46.89 feet to the Southwest corner of property as conveyed in Book 3301, Page 1527; thence North 89 degrees, 57 minutes, 46 seconds East along said line, 907.36 feet to a point on the East line of the West half of the Northeast Quarter of said Section 9; thence South 01 degrees, 35 minutes, 02 seconds West along said line, 1387.35 feet; thence South 89 degrees, 32 minutes, 38 seconds West, 120.00 feet; thence South 01 degrees 35 minutes, 02 seconds West, 120.00 feet to the Point of Beginning.  Containing 45.40 acres, more or less.

 

 

Section 2.   The Legislature, pursuant to the application of Sbisa Homes, Inc.  (RZ-2004-358), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application in a public hearing on December 16, 2004, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
