IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title AN ORDINANCE approving a conditional use permit for the construction of a 150 foot monopole commercial communication tower as to a certain 0.517 + acre tract. Intro ORDINANCE 2615, December 9, 1996 INTRODUCED BY Fred Arbanas, County Legislator Body BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows: Section 1. A conditional use permit for 20 years to construct a 150 foot monopole commercial communication tower, subject to restrictions attached, under the Unified Development Code, is hereby approved as to a certain tract of land described as follows: A 0.517 acre of land generally located at the northwest corner of Missouri Highway 7 and US Highway 50 lying in all that part of the East Half of the Southeast Quarter of Section 7, Township 47, Range 30, Jackson County, Missouri being more particularly described as follows: Commencing at the Southeast corner of the East Half of the Southeast quarter of said Section 7; thence along the East line of said Half of Quarter Section, North 02 degrees, 18 minutes, 33 seconds East, 779.06 feet to a point on the Northerly Right-of-Way line of U.S. Highway No. 50; thence along the Northerly Right-of-Way line of said Highway, North 88 degrees, 10 minutes, 39 seconds West, 55.64 feet to a point 60 feet Right of Missouri state Highway No. 7 Station 190+30; thence continuing along the Northerly Right-of-Way line of said U.S. Highway No. 50, South 32 degrees, 04 minutes, 44 seconds West, 277.85 feet to a point 200 feet Right of said Missouri State Highway No. 7 Station 192+70; thence continuing along the Northerly Right-of-Way line of said U.S. Highway No. 50, South 63 degrees, 57 minutes, 45 seconds West, 210.52 feet; thence leaving the Northerly Right-of-Way line of said U.S. Highway No. 50, North 36 degrees, 02 minutes, 15 seconds West; 12.87 feet to a point of curve, thence in a Northwesterly direction, along a curve to the Right (having a radius of 400 feet), 102.60 feet to a point of tangent; thence North 21 degrees, 20 minutes, 30 seconds West, 155.74 feet to a point of curve; thence in a Northerly direction, along a curve to the Right (having a radius of 300 feet) 120.91 feet to a point of tangent; thence North 01 degrees, 45 minutes, 00 seconds East, 69.64 feet to a point of curve; thence in a Northeasterly direction, along a curve to the Right (having a radius of 65 feet), 64.63 feet to a point of tangent; thence North 58 degrees, 43 minutes, 00 seconds East, 24.24 feet to a point of curve, thence in an Easterly direction, along a curve to the Right (having a radius of 100 feet), 13.58 feet to the Point of Beginning of this tact; thence North 00 degrees, 00 minutes, 00 seconds East, 85.12 feet; thence North 90 degrees, 00 minutes, 00 seconds Est, 150.00 feet; thence South 00 degrees, 00 minutes, 00 seconds West, 150.00 feet; thence South 90 degrees, 00 minutes, 00 seconds West, 150.00 feet, thence North 00 degrees, 00 minutes, 00 seconds East, 64.88 feet to the point of beginning, containing 0.517 acres (22,500.00 s.f.) more or less. Section 2. The Legislature, pursuant to the application of Southwestern Bell Mobile Systems, Inc. (CU-96-012), requesting approval embodied in this ordinance and with notice that the Jackson County Planning Commission unanimously recommended approval of this application in a public hearing on October 24, 1996, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning...Attorney Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
