Body

BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:

Section 1.  The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:

Description:

 

A 35 ± acre tract of land generally located 4/10 of a mile south of Pink Hill Road on the east side of Sweeney Road and more specifically described as:

 

All that part of the Southeast quarter of the Northeast quarter of Section 23, Township 49, Range 30, as described in Document No. I-139813 and all of Lot 3, Peaceful Acres, Lots 1-3, as recorded in Document No. I-962433 in Jackson County, Missouri and further described as follows:  Commencing at the Northwest corner of the Southeast quarter of the Northeast quarter of said Section 23, said point also being the Northwest corner of Peaceful Acres, Lots 1-3; thence South 01 degrees 30 minutes 24 seconds West along the West line of the Southeast quarter of the Northeast quarter of said Section 23 a distance of 320.00 feet to the Point of Beginning; thence South 88 degrees 32 minutes 56 seconds East along the North line and extension thereof of Lot 3 and along the South line of Lot 2, Peaceful Acres, Lots 1-3, a distance of 712.06 feet to the Southeast corner of Lot 2 of Peaceful Acres, Lots 1-3; thence North 01 degrees 27 minutes 04 seconds East a distance of 320.00 feet to the Northeast corner of Lot 2 of Peaceful Acres, Lots 1-3; thence South 88 degrees 32 minutes 56 seconds East a  distance of 618.71 feet to the Northeast corner of the Southeast quarter of the Northeast quarter of said Section 23; thence South 01 degrees 32 minutes 30 seconds West along said East line a distance of 1324.07 feet to the Southeast corner of the Northeast quarter of said Section 23; thence North 88 degrees 29 minutes 22 seconds West a distance of 1329.65 feet to the Southwest corner of the Southeast quarter of the Northeast quarter of said Section 23; thence North 01 degrees 30 seconds 24 seconds East a distance of 1002.69 feet to the Point of Beginning. Containing 35.18 acres Except that part in road.

 

 

Section 2.  The preliminary plan "Peaceful Acres 2nd Plat - Lots 4-7," creating a four-lot residential subdivision, is hereby approved.

 

Section 3.  The Legislature, pursuant to the application of Gary Piatt (RZ-2001-259), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on December 20, 2001, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.

 

Enacted and Approved

Effective Date:  This Ordinance shall be effective immediately upon its signature by the County Executive.
