Body
WHEREAS, the City of Lee's Summit, Missouri has initiated the annexation of certain property currently in the unincorporated areas of Jackson County described as:
The West ½ of the East ½ of the Northeast 1/4 of the Southwest 1/4 of Section 2, Township 47, Range 31, in Jackson County, Missouri except that part conveyed to Jackson County for highway purposes; subject to easements, reservations, covenants and restrictions of record, if any.
and,
WHEREAS, the property owner intends to request a zoning change and preliminary plat from Jackson County to develop the property prior to the anticipated annexation of the property by the City of Lee's Summit; and,
WHEREAS, the Department of Public Works recommends that the City of Lee's Summit agree to certain terms as a condition precedent to the County's approval of the proposed development; and,
WHEREAS, the City of Lee's Summit agrees to provide sewer and water service to the property, perform inspection services of said property and to obtain a Subdivision Improvement Agreement from the developer for all infrastructures required for the proposed development; and,
WHEREAS, the City of Lee's Summit has proposed and approved by ordinance the Intergovernmental Cooperative Agreement attached hereto as "Exhibit A"; and,
WHEREAS, the Department of Public Works recommends the execution of the proposed Intergovernmental Cooperative Agreement; therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the Intergovernmental Cooperative Agreement attached hereto as "Exhibit A" with the City of Lee's Summit, Missouri.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
