Body
WHEREAS, in connection with the Prospect Road Bridge Project, No. 2139-2, the City of Kansas City, Missouri has a need to acquire title to a certain tract of land within said City, located at or near 8900 Prospect Road and described in the attached conveyance instrument, for the completion of the Project; and,
WHEREAS, the City was under the belief that it had acquired the tract by a conveyance in 2003 from the private owners; and,
WHEREAS, the City has now determined that the tract had been conveyed to the County by the private owners in 1995 and the private owners were paid from the City's CURS account; and,
WHEREAS, the City may lose over $9,000,000 in Federal funding if the City does not acquire title to this tract on or before September 30, 2006; and,
WHEREAS, the City has requested the County's cooperation in resolving this matter; and,
WHEREAS, the Director of the Department of Public Works recommends that the tract described in the conveyance instrument be conveyed to the City at no cost to the County and that the County Executive be authorized to execute the conveyance instrument and any other documents necessary to convey this tract to the City on or before September 30, 2006, in furtherance of the public interest; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the attached conveyance instrument and any other documents necessary to convey the herein-described tract to the City of Kansas City, Missouri, in a form to be approved by the County Counselor.
Enacted and Approved
Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
