BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RR" (Residential Ranchette) District so that there will be transferred from District A to District RR a tract of land described as follows:
Description: A 12 ± acre tract of land generally located ½ mile north of Snow Road on the west side of Spainhour Road and more specifically described as:
A PART OF THE NORTHEAST QUARTER OF THE NORTHEAST QUARTER OF SECTION 12, TOWNSHIP 47, RANGE 30, LYING NORTH OF THE SOUTH BANK OF THE RAVINE RUNNING THROUGH SAID QUARTER QUARTER SECTION, AND ALSO A PART OF THE SOUTHEAST QUARTER OF THE SOUTHEAST QUARTER OF SECTION 1, TOWNSHIP 47, RANGE 30, BOTH TRACTS BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: BEGINNING AT THE NORTHEAST CORNER OF SECTION 12, TOWNSHIP 47, RANGE 30, IN JACKSON COUNTY, MISSOURI; THENCE SOUTH 00 DEGREES 07 MINUTES WEST (DEED) SOUTH 01 DEGREES 47 MINUTES 55 SECONDS (PLAT), ALONG THE EAST LINE OF SAID SECTION 12.54.28 (MEAS.) 37.78 FEET (DEED); THENCE SOUTH 57 DEGREES 08 MINUTES WEST (DEED), SOUTH 58 DEGREES 48 MINUTES 55 SECONDS WEST (PLAT), A DISTANCE OF 231.50 FEET TO FOLLOW THE MEANDERINGS OF AN OLD AGREED LINE FENCE RUNNING ALONG THE SOUTH BANK OF SAID RAVINE; THENCE SOUTH 63 DEGREES 32 MINUTES WEST (DEED), 65 DEGREES 12 MINUTES 55 SECONDS WEST (PLAT), FOR 155.00 FEET; THENCE SOUTH 53 DEGREES 39 MINUTES WEST (DEED), 55 DEGREES 19 MINUTES 55 SECONDS WEST (PLAT), FOR 130.00 FEET; THENCE; THENCE SOUTH 47 DEGREES 10 MINUTES WEST (DEED), SOUTH 48 DEGREES 50 MINUTES 55 SECONDS WEST (PLAT), FOR 302.37 FEET; THENCE SOUTH 86 DEGREES 37 MINUTES WEST (DEED), SOUTH 88 DEGREES 17 MINUTES 55 SECONDS WEST (PLAT), FOR 96.16 FEET; THENCE NORTH (DEED), NORTH 01 DEGREES 41 MINUTES 22 SECONDS EAST (PLAT), AND DEPARTING FROM SAID OLD LINE FENCE 942.52 FEET; THENCE NORTH 83 DEGREES 45 MINUTES EAST (DEED), NORTH 85 DEGREES 24 MINUTES 58 SECONDS EAST (PLAT), FOR 760.13 FEET TO THE EAST LINE OF SECTION 1, TOWNSHIP 47 RANGE 30; THENCE SOUTH (DEED), SOUTH 01 DEG REES 40 MINUTES 55 SECONDS WEST (PLAT), A DISTANCE OF 470.03 FEET (MEAS.) 486.69 FEET (DEED) TO THE SOUTHEAST CORNER OF SAID SECTION 1, WHICH IS ALSO THE NORTHEAST CORNER OF SAID SECTION 12, WHICH IS ALSO THE POINT OF BEGINNING, EXCEPT THAT PART IN ROAD AKA 11412 SPAINHOUR ROAD.
Section 2. The Legislature, pursuant to the application of Dale Kelsey (RZ-2001-231), requesting the amendment embodied in this ordinance and with notice that the Jackson County Plan Commission unanimously recommended this application in a public hearing on April 19, 2001, does adopt this ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
