Body
WHEREAS, the Legislature did, by Resolution #15638, dated September 26, 2005, adopt and recognize the National Incident Management System (NIMS); and,
WHEREAS, such resolution was required as a condition precedent for federal emergency preparedness grants for local governments; and,
WHEREAS, the designation of a primary emergency operations center for Jackson County is an additional condition precedent for future federal emergency preparedness grants; and,
WHEREAS, the County's Office of Emergency Preparedness has been and will continue to manage the Eastern Jackson County Emergency Operations Center ("EOC"); and,
WHEREAS, the Eastern Jackson County EOC presently serves as the primary center for Jackson County and serves as a source of direction and coordination for agencies that would be involved in responses to emergencies, including the field forward or incident command responders such as the Jackson County Health Department, the Sheriff's Office and the Medical Examiner; and,
WHEREAS, the Eastern Jackson County EOC also serves as the primary coordinating center for political subdivisions within Jackson County and, when necessary, as the support EOC for these same political subdivisions; and,
WHEREAS; the City of Independence, Missouri ("City") has agreed to provide a location and resources for the Eastern Jackson County EOC at suitable premises at 950 N. Spring, Independence, MO (the "EOC Facility") and has given Jackson County access for the use of the location at no cost to the County; and,
WHEREAS, the City is willing to enter into a Cooperative Agreement with the County setting forth the terms and conditions for the use of the EOC Facility; and,
WHEREAS, it is in the best interests, health, safety and welfare of the citizens of Jackson County to designate the EOC Facility; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the Legislature designates 950 N. Spring as the situs address of the Eastern Jackson County Emergency Operations Center and that said EOC Facility is the primary Emergency Operations Center for Jackson County, Missouri for all federal and state emergency preparedness reporting and grant purposes; and,
BE IT FURTHER RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive is hereby authorized to execute a Cooperative Agreement with the City of Independence, Missouri regarding the terms and conditions for the use the EOC Facility at no cost to the County and in a form approved by the County Counselor.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
