Body
WHEREAS, Section 1040.1 of the Jackson County Code, 1984, eliminates the requirement for competitive bidding when items to be purchased can be obtained from only one source; and,
WHEREAS, Section 1063.00 of the Code requires notification of and approval by the Legislature on such sole source purchases exceeding $5,000.00; and,
WHEREAS, the Purchasing Director recommends a contract with Dean Machinery Company of Kansas City (Jackson County), MO, in the estimated amount of $15,000.00, for the furnishing of Caterpillar parts and service for use by the Public Works Department to provide for departmental needs for the upcoming one-year period; and,
WHEREAS, the Purchasing Director further recommends that he not take competitive bids with regard to said contract for the reason that Dean Machinery Company of Kansas City, MO is the only factory-authorized supplier of Caterpillar parts and service in the Kansas City metropolitan area; therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that award be made as recommended by the Purchasing Director, and that the Purchasing Director be, and is hereby, authorized to execute for the County a contract with Dean Machinery Company of Kansas City, MO, and any and all documents necessary to the accomplishment of the award; and,
BE IT FURTHER RESOLVED that the Director of the Department of Finance is authorized to make all payments including final payment on the contract, to the extent sufficient appropriations to the using spending agency have heretofore been made in the current Jackson County budget.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.

This award is made on a need basis and does not obligate Jackson County to pay any specific amount. The availability of funds for specific purchases will, of necessity, be determined as each using agency places its order, with certification made at that time within amounts previously budgeted for the spending agency.
