BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows:
Section 1. The Zoning Order of Jackson County, Missouri, and the official maps which are a part thereof, are amended by changing the boundaries of the "A" (Agricultural) District and the "RE" (Residential Estates) District, so that there will be transferred from District A to District RE, a tract of land described as follows:
Description:
The 3.4 ± acres are generally located ½ of a mile east of Buckner Tarsney Road on the north side of Oak Hill School Road and specifically described as part of the SW ¼ of the NE ¼ of Section 11, Township 48 north, Range 30 west, in Jackson County, Missouri, described as follows: commencing at the southwest corner of said SW ¼ of the NE ¼; thence S 87̊44'21" E along the south line of said ¼ ¼, a distance of 654.25 feet to the point of beginning, said point being on the west line of the east ½ of said ¼ ¼ section; thence N 01̊54'48" E along the west line of the east ½ of said ¼ ¼ section, a distance of 436.36 feet; thence S 87̊44'21" E parallel with the south line of said ¼ ¼ section, a distance of 337.88 feet; thence S 01̊48'20" W along a line parallel with and 30 feet distant from the west line of "Schmidt Acres", a subdivision in said County and State, a distance of 436.36 feet to a point on the south line of said ¼ ¼ section line; thence N 87̊44'21" W along said south line, a distance of 338.61 feet to the point of beginning, containing 3.392 acres, more or less, all being subject to easements, rights of way, and restrictions of record, aka 33412 Oak Hill School Road.
Section 2. The Legislature, pursuant to the application of Ben Schmidt (RZ-2007-438), requesting the amendment embodied in this Ordinance and with notice that the Jackson County Plan Commission unanimously recommended approval of this application at a public hearing on July 19, 2007, does adopt this Ordinance pursuant to the Jackson County Charter authorizing the Legislature to exercise legislative power pertaining to planning and zoning.
Enacted and Approved
Effective Date: This Ordinance shall be effective immediately upon its signature by the County Executive.
