IN THE COUNTY LEGISLATURE OF JACKSON COUNTY, MISSOURI Title AN ORDINANCE amending the Jackson County Zoning Order dated June 20, 1960, containing the zoning map of Jackson County, to implement the Unified Development Code (Ordinance 2363) by providing that certain zoning districts be re-titled to conform with the Unified Development Code zoning district titles, with a penalty provision. Intro ORDINANCE # 2488, November 6, 1995 INTRODUCED BY Fred Arbanas, County Legislator Body WHEREAS, a key element of the Jackson County Master Plan "Strategy for the Future," adopted by the Legislature pursuant to Ordinance 2265 on January 18, 1994, was the implementation of a Unified Development Code, which would govern the development of land in unincorporated Jackson County; and, WHEREAS, the Unified Development Code adopted by the Legislature pursuant to Ordinance 2363 on May 23, 1995, provides land development regulations in accordance with the adopted Master Plan, for the purpose of promoting the health, safety, comfort, convenience, morals, and general welfare of the unincorporated area; and, WHEREAS, the Unified Development Code has established zoning districts to classify and segregate the use of land and buildings; and, WHEREAS, the Official Zoning Map of Jackson County, Missouri ("Zoning Map") illustrates the boundaries of all zoning districts by classification; and, WHEREAS, the change in the titles of certain zoning districts pursuant to the Unified Development Code has no effect on any of the substantive or procedural zoning regulations otherwise applicable to such zoning districts; and, WHEREAS, the Legislature has determined that there is a necessity for this change in the zoning map and that such change is in the best interest of the public at large and the citizens of Jackson County, and that such change will promote the general health, safety and welfare of this community; now therefore, BE IT ORDAINED by the County Legislature of Jackson County, Missouri as follows: SECTION 1. The Zoning Map, adopted through the Zoning Order dated June 20, 1960, is hereby amended by titling the following districts as set forth herein: Existing Zoning District Title New Zoning District Title (Per Unified Development Code) "D" - Agricultural "A" - Agricultural "E" - Local Business "LB" - Local Business "F" - General Business "GB" - General Business "G" - Light Industrial "LI" - Light Industrial "H-1" - Limited Heavy Industrial "H" - Heavy Industrial "HI" - Heavy Industrial SECTION 2. In all respects the regulations applicable to the use of land in the new districts described in the Unified Development Code and by this Ordinance inserted on the Zoning Map shall be as contained in the Jackson County Unified Development Code, adopted through Ordinance 2363, and all other pertinent ordinances of Jackson County. SECTION 3. This Ordinance shall be cumulative of all other ordinances of Jackson County affecting zoning and shall not repeal any of the provisions of said ordinances except in those instances where provisions of existing ordinances are in direct conflict with the provisions of this Ordinance. SECTION 4. The terms and provisions of this Ordinance shall be deemed to be severable and that if the validity of any section, subsection, sentence, clause, or phrase of this Ordinance should be declared to be invalid, the same shall not affect the validity of any other section, subsection, sentence, clause, or phrase of this Ordinance. SECTION 5. Any person, firm, or corporation violating any of the terms and provisions of this Ordinance shall be subject to the penalties provided for in Ordinance 2363, the Jackson County Unified Development Code...Attorney Effective Date: This ordinance shall be effective immediately upon its signature by the County Executive.
