A RESOLUTION authorizing the County Executive to execute warranty deeds relating to a certain 8.5 acre tract of park property within River Bluff Park in favor of Burlington Northern & Santa Fe Railway, a permanent ingress/egress easement at River Bluff Park in favor of Burlington Northern & Santa Fe Railway, and Project Amendment No. 4 to the Project Agreement with the Missouri Department of Natural Resources to authorize the conversion of the park property.

Body
WHEREAS, by Resolution 16179, dated February 26, 2007, the Legislature did express its support of the proposed conversion and conveyance of an 8.5 acre tract of park property within River Bluff Park to facilitate a track replacement project to realign two existing main tracks and construct a third main track along a ten-mile section of land; and,
WHEREAS, the Missouri Department of Natural Resources, Division of State Parks, and the U. S. Department of the Interior have now formally approved the conversion request; and,
WHEREAS, the Director of Parks and Recreation recommends the execution of the proposed warranty deeds relating to a certain 8.5 acre tract of park property within River Bluff Park in favor of Burlington Northern & Santa Fe Railway, a permanent ingress/egress easement at River Bluff Park in favor of Burlington Northern & Santa Fe Railway, and Project Amendment No. 4 with the Missouri Department of Natural Resources; and,
WHEREAS, the County will receive a fee of $19,708.40 for the permanent ingress/egress easement and a fee of $2,000.00 plus 25.90 acres of adjacent land in exchange for the transfer of the 8.5 acre tract; and,
WHEREAS, the proposed conveyance, easement, and agreement are in the best interests of the citizens of Jackson County; now therefore,
BE IT RESOLVED by the County Legislature of Jackson County, Missouri, that the County Executive be and hereby is authorized to execute the warranty deeds, easement, and Project Amendment No. 4, and any and all other documents necessary to the accomplishment of this transaction, as recommended by the Director of Parks and Recreation.

Effective Date: This Resolution shall be effective immediately upon its passage by a majority of the Legislature.
